The Kano State Upper Shari'ah Court has declared Asiya Abdullahi Umar Ganduje and Inuwa Uba's marriage null and void in accordance with Islamic law (Khul'I).
Asiya Ganduje, the daughter of the governor of Kano state, petitioned the court to dissolve her marriage through her attorney, Barrister Ibrahim Aliyu Nassarawa, stating that she was fed up and prepared to return the N50,000 she had received as dowry.
Umar I Umar, the defendant's attorney, responded to the plaintiff's claim by arguing that Asiya still held onto some of his client's goods and that the plaintiff's claim extended beyond the dowry alone.
The trial judge, Mallam Abdullahi Haliru, declared that the plaintiff was given the sum of N50,000 based on the evidence submitted.
He contended that because the dowry is the traditional cornerstone of a marriage, the court should base its ruling on it.
Asiya has been ordered by a judge to repay the N50,000 dowry she received.
The respondent's counsel, Umar I Umar, spoke to the court after the verdict was announced and requested a copy of the transcript so he could appeal the decision to the Upper Court.
