General Faruk Yahaya, the Chief of Army Staff of Nigeria, and Major General Stevenson Oluwagbenga Olabanji, the Commander of Training and Doctrine Command, have been ordered to be arrested and detained at Minna Correctional Centre by Justice Halima Ibrahim Abdulmalik of a High Court in Minna, Niger State.
At the resumption of a case with the case number NSHC/225/2019 between Adamu Makama, 42 additional plaintiffs, the Executive Governor of Niger State, and seven additional defendants, Justice Abdulmalik issued the ruling.
For disobeying the court’s order from October 12, 2022, “an order is made committing the Chief of Staff of the Nigerian Army, General Farouk Yahaya, and the Commander, Training and Doctrine Command (TRADOC) Minna, i.e. 6th and 7th respondents, into the custody of the Correctional Centre.”
The court ruled that until the defendants “purge themselves of the contempt,” they must remain in the custody of the Correctional Centre.
The order has been issued based on Justice Abdulmalik’s interpretation of Order 42, Rule 10 of the 2018 Niger State High Court Civil Procedure.
The court has set the next hearing date for December 8, 2022.
