Through his attorney, Malam Usman Kuso, Abdullahi requested that the court order the sale of Sha'aban's property, including buildings and land, in order to recoup his debt of N11.2 million and $1 million.
Malam Aminu Jumare, the presiding judge, adjourned the case until January 4 after urging the parties to look into alternative peaceful resolution options permitted by Islamic law.
Earlier, Kuso also asked the court for permission to sell Sha'aban's other properties in the event that the collateral for the loan agreement failed to recoup the debt.
He claimed that Sha'aban was friends with the plaintiff.
He claimed that sometime in 2018, Sha'aban approached this client and asked for a loan in the company of their friend Malam Bashir Abubakar.
He continued by saying that the plaintiff complied and asked for a contract and security in line with Islamic Laws.
According to Kuso, the defendant designated his attorney Isma'ila Jamoh to draught the agreement in accordance with the plaintiff's request for the collateral and agreement.
He claimed that the defendant's property was used as security for the loan.
The conveyance of approval number 009234 was attached to the land and building at number 48 Yusuf Road off Hadejiya Road in Bampai Kano, Kano State, he continued.
Others, he added, include Mazari Ltd., which is situated in Zaria, Kaduna state, along the Kano-Kaduna Expressway with C of O KD 6246.
Additionally, Kuso informed the court that Sha'aban was in Dubai when he solicited the loan from his client (UAE,).
He emphasised that the loan agreement had also been approved by the Commissioner for Oath at the Kaduna state High Court of Justice and that Sha'aban had designated his son Mohammed-Turad to sign the contract on his behalf.
According to Kuso, the plaintiff then released the funds to the defendant.
Nasir Sa'id, the defendant's attorney, refuted any agreement with the plaintiff in his response.
He claimed that the plaintiff's allegations did not specify the precise day the money was paid to his client or the method used to do so.
